IHC directs FBR not to recover Rs 98.8m from Pakistan Mobile Telecommunication

ISLAMABAD: The Islamabad High Court (IHC) on Friday restricted the Federal Board of Revenue (FBR) from recovering outstanding tax amount of Rs 98.869 million along with default surcharge of Rs 30.526 million from Pakistan Mobile Telecommunication Limited.

A single bench of the IHC comprising Justice Aamer Farooq heard the case, seeking restrictions for the FBR from recovering the said amount till decision over stay application pending before the Appellate Tribunal Inland Revenue (ATIR).

While disposing of the case, the bench also directed the ATIR to decide the stay application, challenging FBR’s claims about outstanding amount within 60 days.

The appellant had challenged a recovery order of Large Taxpayers’ Unit, dated July 30, 2015. Federal Board of Revenue (FBR), ATIR and LTU’s officers were made party in the case.
