ISLAMABAD: The Islamabad High Court (IHC) has directed the Regional Tax Office to decide M/s Treasure National Police Foundation’s application pending before the Inland Revenue-Appeals commissioner within 7 days and submit a compliance report to the IHC.
A single bench of the IHC comprising Justice Aamer Farooq also restrained the Islamabad RTO from recovering outstanding tax amount of Rs 8.250 million from M/s Treasure National Police Foundation.
M/S Treasure National Police Foundation had challenged an RTO order stating that the said amount as recoverable under the head of income tax before the IHC after exhausting the departmental platform for appealing disputing orders.
RTO IR chief commissioner and IR Appeals commissioner and others were made respondent in the case.
The appellant had prayed the court to direct the RTO not to recover the said amount and abstain from any coercive action in this regard.
The appellant submitted before the court that the impugned order was issued under mala fide intentions and had no legal standing or authority and the court may decide on relief which it deemed appropriate in this regard.
