IHC directs LTU to decide appeal of M/s Linkdotnet Telecom within 60 days

ISLAMABAD: A single bench of the Islamabad High Court has decided a tax matter filed by M/s Linkdotnet Telecom Limited and restricted the Federal Board of Revenue (FBR) from recovering the tax amount of Rs 436.7 million from the company.

The court also directed the Large Taxpayers’ Unit, Islamabad to decide M/s Linkdotnet Telecom Limited’s departmental appeal pending before the commissioner appeals within 60 days.

The single bench, comprising Justice Aamer Farooq, decided the matter in favour of the appellant who had challenged the LTU’s order mentioning Rs 436.7 million as outstanding recoverable amount.

The LTU had issued the notice for tax year 2007 under the head of income tax under provisions of the Income Tax Ordinance, 2001.

In its decision, the bench had also restricted the FBR’s field office, LTU, form recovering the said amount till deciding the departmental appeal of appellant. The appellant had made FBR, and officers of LTU, respondents in the case.
