IHC directs LTU to decide appeal of M/s Orient Power Company Limited within 30 days

ISLAMABAD: The Islamabad High Court (IHC) has disposed of a case filed by M/s Orient Power Company (Private) Limited with directions to the Large Taxpayers Unit to hear and decide the appellant’s departmental application within 30 days.

M/s Orient Power Company Private Limited had filed a tax reference challenging a show cause notice issued by field office of Federal Board of Revenue (FBR) i.e. Large Taxpayers Unit, Islamabad.

A single bench of the IHC comprising of Justice Athar Minallah disposed of the case. The bench also barred the department from taking any coercive measures against the company for recovering the disputed amount under the head of taxes.

ATIR, Federal Board of Revenue (FBR), officers of LTU including Commissioner Inland Revenue, Deputy Commissioner Inland Revenue and Commissioner Inland Revenue (Appeals) were made respondent in the case.

The company also stated that the show cause notice mentioning outstanding tax amount was issued with mala fide intentions and that the departmental obligations were not met while processing the recovery notice. Later, the adjudication did not address grievances of the appellant.
