IHC hears number of cases against FBR’s field offices

ISLAMABAD: Hearing a number of tax matters during third week of May, different benches of the Islamabad High Court held hearing of cases filed against the field offices of the Federal Board of Revenue (FBR).

In this regard, IHC Division Bench, comprising of Justice Athar Minallah and Justice Mohsin Akhtar Kiyani, disposed of a tax matter filed by M/s Huawei Technologies remanding back the case to the Appellate Tribunal Inland Revenue (ATIR). The bench was hearing a case filed in 2011.

M/s Huawei Technologies had contested a show cause notices issued by the field offices of the Federal Board of Revenue.

According to details, M/s Huawei Technologies had challenged the recovery of outstanding sales tax by the LTU Islamabad.

M/s Huawei Technologies had submitted that the department had issued the demand for the tax year 2010 in head of sales tax.

Justice Miangul Hassan Aurangzeb issued directives in a case filed by M/s Halmore Power Generation. The bench asked the parties to prepare for arguments and present more record before the bench.

M/s Halmore Power Generation had challenged a show cause notice issued by the Additional Commissioner Inland Revenue Islamabad.

M/s Halmore Power Generation had filed the case against the RTO Islamabad.

Appellate Tribunal Inland Revenue (ATIR), Federal Board of Revenue (FBR), officers of RTO, including Commissioner Inland Revenue, Deputy Commissioner Inland Revenue and Commissioner Inland Revenue (Appeals), were made respondents in the case.

M/s Halmore Power Generation had filed the case seeking restrictions for RTO Islamabad about recovering outstanding tax amount or making any other coercive move prior to court’s directions on the issue.

Meanwhile, Justice Aamer Farooq dated in office hearing on a case by relisting a tax matter submitted by M/s Ahsan Elahi and Co.

M/s Ahsan Elahi and Co had filed the reference in which the company had challenged a show cause notice issued by the Large Taxpayers Unit Islamabad.

The same bench also dated in office hearing on M/s Hasas Engineering and Construction Company Private Limited with the submission of related documents.

The bench, comprising of Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb, heard the case. The IHC Division Bench on the day dated in office the hearing on the matter after the counsels submitted documents as per directions of the bench.
