IHC seeks record from counsels on petition filed by M/s Pakistan Mobile Communication

ISLAMABAD: A division bench of the Islamabad High Court (IHC) on Thursday directed counsels from sides to submit record in a tax matter filed by M/s Pakistan Mobile Communication Limited.

The bench comprising Justice Athar Minallah and Justice Miangul Hassan Aurangzeb heard the case. M/s Pakistan Mobile Communication Limited had filed the reference against ATIR and had challenged its announcement before the court. The FBR field office, Large Taxpayers Unit’s officers, was also made respondent in the case.

The appellant had submitted that the ATIR had maintained decision of the LTU adjudication in ignorance of law and the appellant’s submissions were not addressed completely, challenging recovery of outstanding tax amount.

In recent months, another IHC bench comprising Justice Aamer Farooq had disposed of M/S Pakistan Mobile Communication Limited’s case challenging recovery of Rs 415,903,733 under the head of income tax.

The bench had also barred the LTU from making any recovery from the appellant till decision on appellant’s application pending before the LTU.

M/S Pakistan Mobile Communication Limited had named chief commissioner Inland Revenue, LTU, assistant commissioner Inland Revenue Withholding, LTU, commissioner Inland Revenue (Appeals), LTU, and Federal of Pakistan through the chairman of Federal Board of Revenue (FBR) as respondent in the case.

M/s Pakistan Mobile Communication Limited had challenged a show cause notice, dated November 27, for the tax year 2014, in head of income tax under sections of Income Tax Ordinance, 2001.
