Importer moves SHC against detention of imported goods

KARACHI: Importer Syed Saddruddin has approached the Sindh High Court (SHC) and filed petition against detention of his imported goods by officials of Collector of Customs Preventive.

On 15 February 2020, counsel for the petitioner stated that petitioner is the law abiding and peace loving citizen of Pakistan and he attends the notable respect in the society and known as one of honest person and respectfully submitted here under for kind consideration and just orders against the respondents and his subordinates who refused to release the container & goods in question in the light of order in customs appeal no: K-285/2018 passed by the customs appellate tribunal, bench-I at Karachi in favor of the petitioner accordance with law.

He further submitted that petitioner is suffering since 2017 despite the order passed by customs appellate tribunal and value of the goods is deteriorating day by day, there is no stay against the goods of the petitioner and the said goods is the only source of income of the petitioner.

He argued that petitioner is suffering due to illegal act of the respondents which is the clear violation of article 4, 18, 24, 25 the constitution.

Citing secretary Ministry of Finance, Islamabad and Collector of Customs Customs Collectorate Preventive as respondents, petitioner pleaded the court may direct the respondents to release the goods of the petitioner is the light of order dated 22/10/2018 passed in customs appeal which is in favor of the petitioner.

He further pleaded the court may prohibit and restraint the respondents and their officers from taking any coercive action against the petitioner in respect of the said goods also restrain the respondents for safe of goods till disposal of the constitutional petition.
