Islamabad High Court adjourns hearing of several cases during 1st week of November

ISLAMABAD: Hearing of a number of tax references, the Islamabad High Court (IHC) disposed of one matter while adjourned the hearing of others challenging tax recovery claims issued by the Federal Board of Revenue (FBR) during the first week of November.

Majority of these references were heard by the IHC single bench comprising Justice Aamer Farooq while one was heard by IHC division bench, comprising Justice Shaukat Aziz Siddiqui and Justice Mohsin Akhtar Kayani.

Hearing one such cases, Justice Farooq disposed of a tax reference barring the Federal Board of Revenue (FBR) from recovering outstanding tax amount of Rs 20,200,080 from M/s Pakistan Engineering Council on Friday.

The bench also directed FBR field office, Regional Tax Office, Islamabad, to decide fate of appellant’s appeal within seven days.

Same bench also heard M/s Pakistan Telecom Mobile Limited’s reference challenging recovery of outstanding tax amount of Rs 6,954,723 claimed by the field office of Federal Board of Revenue (FBR). Justice Farooq adjourned hearing of the matter.

M/s Pakistan Telecom Mobile Limited, through the submission, had challenged show cause notice for recovery of Rs 6,954,723 under the head of income tax.

Justice Farooq also adjourned hearing of a tax reference filed by M/s Zhongxing Pakistan Private Limited seeking restrictions for Federal Board of Revenue from charging outstanding tax amount of Rs 71,342,536.

IHC division bench comprising Justice Shaukat Aziz Siddiqui and Justice Mohsin Akhtar Kayani heard the case filed by M/s Pakistan Oil Field Limited and adjourned for further arguments. The bench directed the counsels to submit details of board’s show cause notice relating to the appellant.

M/s Pakistan Oil Field Limited had filed the case challenging an announcement made by the Appellate Tribunal Inland Revenue (ATIR)-through which it had sustained decision announced by the department’s adjudication pertaining to the show cause notice to M/s Pakistan Oil Field Limited for outstanding tax recovery.
