Judge scolds police for arresting FBR union members prior to filing of FIR

LAHORE:  Additional Sessions Judge Shahida Saeed said police showed misconduct by arresting members of Federal Board of Revenue CBA Union prior to registration of a first information report (FIR).

According to a petition, Federal Revenue Alliance Employees Union arranged a prayer service for those killed in Peshawar by TTP terrorists. Old Anarkali Police SHO with other cops illegally whisked away the union members.

The petitioner requested the SHO to release the arrested persons but the latter gave threats.

The petitioner was left with no option but to file a petition. He also requested the court to order a bailiff to recover the detained officials.

Those arrested were Naeem Abbas Shah, Mian Abdul Qayyum, Aslam, Waseem Sarwar Dar, Miraj Khan, Amir Nazir, Ayyaz Qureshi, Nadeem Punu, Chaudhry Iftikhar, Mukamal Khan, Bashir Niazi, Razi Abbas and Tariq Jhangvi.

After the instructions of the court, bailiff raided Old Anarkali Police Station at 3:55pm on December 24, 2014 whereas FIR No 569/2014 was registered at about 4pm.

Additional Sessions Judge Shahida Saeed said in her decision, “Such act on the part of the police officials is highly objectionable… It appears that malpractices on the part of police have been done, therefore, both the cases are referred to SSP investigation who shall look into the same and to proceed further in accordance with law. While keeping in view all the facts and circumstances of this case at present the custody of alleged detainees by the police appears to be based on mala fide [intentions]…”

She also wrote that if malpractices were proved against any police official concerned, he would be dealt in accordance with law.
