LAHORE: The Lahore High Court (LHC) has adjourned a case against imposition of extra sales tax on petroleum products till December 9, 2016. Pakistan Tehreek-e-Insaf (PTI) woman leader Andleeb Abbas challenged the extra sales tax on petroleum products on November 23.
Justice Aisha A Malik heard the case in which, the counsel for the petitioner, Shiraz Zaka, submitted that the federal government could not impose sales tax on petroleum products without getting approval from Parliament, as per Article 77 of the Constitution of Pakistan. He added that 17 percent sales tax is being charged on petroleum products without seeking approval from parliament, he added.
He said despite fall in prices of the petroleum products in the international market, the government fails to provide relief to the people.
In the petition appellant appeal before the LHC to restrain the government from collecting extra sales tax on petroleum products because extra collection of sales tax is burden on general public. Deputy Attorney General of Pakistan also submitted reply in the case.
After hearing arguments from the appellant and respondents sides, the LHC adjourned the hearing of case till December 9.
Earlier, the same petition was filed by leader of the opposition in Punjab Assembly Mian Mehmood-ur-Rashid.
