LHC directs commissioner appeals to decide sales tax cases within two weeks

LAHORE: The Lahore High Court (LHC) has expressed concerns about the Federal Board of Revenue (FBR) on slow proceeding of appeals of taxpayers. The LHC has ordered the commissioner appeals to solve sales tax cases within two weeks.

According to the details, Justice Shahid Kareem heard the case filed by the Nickson and Mackson Company on sales tax. The counsel for the appellant argued before the court that the FBR has imposed Rs 2.7 million sales tax on the company without consent of the appellant and that is illegal.

The appellant has filed the appeal before the commissioner appeals but after passage of few months, the commissioner appeals did not decide the case, the counsel added.

The counsel prayed to court that according the laws of Federal Board of Revenue (FBR) the commissioner appeals is bound to decide the case within 15 days but commissioner appeals deliberility did not decide the case for the purpose of that FBR ensure recovery from the taxpayers.

He appealed to court to order  commissioner appeals to decide the taxpayers  cases within fifteen cases.

After hearing the iniatial arguments Lahore High Court showed disappointment with the Federal Board of Revenue (FBR) that hundrads of appeals proceedings are pending before the commissioner appeals and waiting for final decisions.

Justice Shahid Kareem remarked in the case that dozons of petitions are filed in the Lahore High Court (LHC) that FBR delaying the decisions of cases filed by the taxpayers.  He added that , if any case of such type will file in the Lahore High Court(LHC) then LHC will call FBR officers.

The Lahore High Court (LHC) has orderd the commissioner appeals to decide the cases within two weeks.
