The counsel for appellant filed the case in the court and maintained that the customs authorities have impounded the 3500-CC vehicle of the petitioner on the smuggling charge. Upon the demand, the plaintiff had also showed the legal documents of the vehicle to the customs authorities.

Despite showing the documents of the legal possession of the vehicle, the authorities did not release the vehicle to its authorized owner. So he appealed the court to issue the order for releasing the vehicle to the its lawful owner.
