LHC orders for sales tax adjustment to importers

LAHORE: Lahore High Court (LHC) has allowed for the adjustment of sales tax paid by the importers on the different imports from many countries.

On 27.2.2019, Justice Shahid Karim was heard the petition filed by the M/s Mughal Steel Limited against the federal government and Federal Board of Revenue.

During the proceeding, the counsel for appellant advocate Muhammad Mohsin Virk argued before court that to stop of sales tax adjudment is against the sales tax general order and the stoppage of sales tax adjustment by the Federal Board of Revenue (FBR) is also violation of article 10 of constitution of Pakistan.

He prayed before the LHC that court may null and void the Federal Board of Revenue (FBR) step to stop the sales tax adjustment on import.

On the other hand the legal advisor by the Federal Board of Revenue argued before the court that the taxpayer is not permitted for the sales tax adjustment before the June 2018.

After hearing arguments from both sides, LHC allowed for the sales tax adjustment to the importers.
