LAHORE: The Lahore High Court sought reply from Ministry of Finance and Law by March 15 on an application moved against the imposition of fixed sales taxes on petroleum products and Section 3 of sales tax act.
As per details, Justice Shahid Waheed heard the case where counsel for applicant argued that Parliament has authority to impose tax under Article 77 of the constitution, but Finance Ministry has imposed tax through notification that is illegal and unconstitutional.
He further argued that the government can provide guideline regarding the taxation, but here the government has itself fixed the sales tax and imposed it on petroleum products.
He requested the court to declare the notification for the promulgation of Section 3 of sales tax act illegal.
