LHC sets aside FBR RD notification

LAHORE: The Lahore High Court (LHC) on Tuesday has set aside Federal Board of Revenue (FBR) notification (1035(1)/2017) under which regulatory duty was imposed on import of various imports.

Justice Shahid Karim passed the orders while allowing various petitions, filed by M/s Global Steel (Pvt) Limited and others challenging the notification.

During the proceedings, the petitioners’ counsel submitted that the FBR, with the approval of the minister-in-charge, had issued a notification, imposing regulatory duty on import of various steel items, in exercise of powers under sub-section 3 of section 18 of the Customs Act 1969.

They contended that the approval of federal minister was not sufficient under the constitution and the apex court judgment in case of M/s Al-Mustafa Impex.

They contended that the FBR was not empowered to issue the impugned notification hence it was liable to be set aside.

However, the FBR counsel opposed the plea submitting that the board had the authority to issue the notification under the rules. It is pertinent to mention here that the Sindh High Court had already set aside the said notification.
