LHC suspends anti-dumping duty on imports collected by NTC

LAHORE: The Lahore High Court (LHC) has suspended the anti-dumping duty on imports. Justice Aisha-A-Malik issued the order on the appeal of M/s Sara enterprises and 14 others.

Counsel for appellant Shafqat Chohan argued before the court that the chairman and other Members of the National Tariff Commission (NTC) were appointed against the merit and on political basis. After the decision of the court, all three members of the NTC were removed but the duties imposed by chairman are being collected to date on the imports of tiles, paper, Iron and other things.

According to the law, the members of the National Tariff Commission must be five in numbers but without appointment of members, the NTC is collecting import duty as anti-dumping tax from the importers.

The counsel appealed the court that in the light of illegal formation of the National Tariff Commission, the LHC should declare null and void the tax notices issued by the NTC to the importers. The court also suspends the board of governors without chairman.

After hearing arguments, the court issued the stay order on the collection of anti-dumping duty on the imports of Iron, paper, steel and other things. The court also issued notice and called the federal government and National Tariff Commission.
