The counsel for appellant argued that Assistant Commissioner Inland Revenue (ACIR) has sent notices to the appellant M/s Moiz Textile Mills but under the law only commissioner Inland Revenue (CIR) is authorized to send audit notices.

Adding more the tax notices sent by the assistant commissioner is illegal and court may declare the same as null and void the tax notices by the assistant commissioner of FBR.

After hearing the arguments from both sides, Lahore High Court (LHC) suspended the audit notices by the Assistant Commissioner Inland Revenue (ACIR), Federal Board of Revenue (FBR) and Court called the Federal Board of Revenue in the next date of hearing for further arguments.
