LHC suspends RD imposed over 400 imported items

LAHORE: The Lahore High Court (LHC) has temporarily suspended SRO No 1035 issued on 16th October imposing Regulatory Duty on more than 400 imported items. The appeal was filed by the Kakub Enterprises.

According to details, Justice Shams Mehmood Mirza heard the case against levy of Regularity Duty on more than 400 imported items by the Government of Pakistan.

Mohsin Virk advocate appeared before the Court by the appellant side and argued that federal government has amended the sub section 3 of section 18 of Customs Act 1969.

He further prayed that permission from the federal cabinet is necessary for the amendment in law but federal government has amended the law on his own will, without taking approval from cabinet and also imposed regulatory duty on import of more than four hundred imported items. Adding more, amendment in the law without permission of cabinet is also the violation of the Supreme Court orders.

Counsel for the appellant prayed before the Court that Statuary Regularity Order (SRO) by Federal Government regarding Regularity Duty on imported items should be declared null and void.

After hearing the arguments from the complaint side Lahore High Court (LHC) has suspended the SRO 1035 of 16 October temporarily and issued notices to the federal government and Federal Board of Revenue (FBR) with orders to submit reply within two weeks. Court also adjourned till next date of hearing.
