LHC to conduct day-to-day hearing of Chaudhary Sugar Mill case from 20th

LAHORE: The Lahore High Court adjourned the hearing of Chudhary Sugar Mills till 20th of February. The LHC also issued an order that learned counsels for the parties are in agreement, so instead of taking up the stay applications, main appeals be heard on a day-to-day basis from 20th of February 2017. It is also agreed between the parties that the august order for the respondents submits that restraining order dated 09.02.2017 passed by the august Supreme Court of Pakistan in civil petitions.

Appellant mills namely M/s Chaudhry Sugar Mills Ltd (R.Y. Khan), Ittefaq Sugar Mills (Bahawalpur) and Haseeb Waqas Sugar Mills (Muzaffargarh) are still operational and carrying out production activities. They submitted that media is also reporting the same.

Before proceeding further, we want to be fully satisfied that the order of the august Supreme Court of Pakistan is being implemented in letter and spirit.In order to verify the ground position, we depute the following learned District & Sessions Judges to immediately verify whether the mentioned mills are in operation.

Learned District & Session Judges shall keep in mind that the restraining order issued by the august Supreme Court of Pakistan was w.e.f. 12.02.2017. In case the learned District & Session Judges find that the mills are still in operation, they will immediately seal the production process of the mills.

The DPOs/RPOs concerned are directed to accompany the learned District & Sessions Judges and render full support in carrying out the verification/inspection directed by this court.

The senior most officers of the Industries Department in the above districts are also directed to accompany the learned District & Sessions Judges and render full assistance regarding the technical aspects of the inspection/verification. The learned District &Sessions Judges shall submit their reports, duly cosigned by the DPO/representative of the Industries Department and the representative of the mills’ managements within three days from today.

The Supreme Court of Pakistan, restraining the manufacturing/operation of the appellants’ mills, shall continue till further orders. Accordingly this order will be read in connected cases bearing ICAs No.1455 and 1489 of 2016.
