M/s Durt Apparels moves SHC against detention of woven microfiber fabric’s consignment

KARACHI: M/s Durt Apparels has approached The Sindh High Court (SHC) and filed a constitutional petition against detention of its imported consignment of polyester woven microfiber fabric weighing 11.184 on the basis of valuation ruling no 1301/ 2018 dated May 04, 2018.

On 4 December 2020, during the hearing, counsel for the petitioner stated that petitioner is duly registered association of persons engaged in import and trading of various textile materials including polyester undyed unfinished fabric from worldwide sources including China in the name of M/s Durt Apparel.

He argued that being arrived with arbitrary putting on hold the consignment of polyester woven microfiber fabric weighing 11.184 MT imported by the petitioner which duly processed, examined and assessed by the clearance collectorate on the basis of valuation ruling no 1301/ 2018 dated May 04, 2018 and attempted initiation of prosecution proceedings against the petitioner on the false and frivolous charges of mis-declaration under section 32 of the customs act, 1969.

Citing secretary revenue division, collector of Customs Appraisement & Facilitation West and Director of Directorate General of Intelligence & Investigation-Customs as respondents, petitioner pleaded the court to declare that the putting on hold the duly examined, assessed and duty paid out of charge consignment of polyester woven microfiber fabric by the respondents is altogether illegal, mala-fide and without jurisdiction.

Counsel further pleaded the court to direct them to allow the provisional release of the consignment and refrain from taking any adverse action against the petitioner & its clearing agent.
