M/s Foton JW Auto Park moves SHC against imposition of customs duty on imports of CKDs

KARACHI: M/s Foton JW Auto Park Private Limited approached the Sindh High Court (SHC) and filed a petition against imposition of 7 percent additional customs duty on imports of CKDs under the garb of SRO 670(1)/2019 dated 28 June 2019.

On 25 April 2020, counsel for the petitioner stated in his petition that petitioner is engaged in imports, he is manufacture of commercial vehicles, marketed under the brand “For land” and fulfills all legal formalities according with law and contributes huge amount of duty and taxes in Pakistani exchequer.

Counsel argued that however, petitioner is seriously aggrieved and prejudiced by the action of the respondents, who unlawfully imposed 7 percent additional customs duty and taxes on imports of CKDs vide SRO 670(1)/2019 dated 28 June 2019.

Citing secretary Federal Ministry of Finance, chairman Federal Board of Revenue, Customs Collectorate Appraisement West, East and Port Muhammad Bin Qasim as respondents, petitioner pleaded the court to to declare that act of the respondents as illegal, malafide and arbitrary.

Counsel further pleaded the court to set aside impugned direction of customs officials regarding additional levy and restrain them from taking any coercive action against the petitioner till final order in this petition.
