M/s Umer Steel moves SHC against detention of imported goods

KARACHI: The Sindh High Court (SHC) issued notices to the customs officials and deputy attorney general of Pakistan and directed them to file their respective para wise comments on a constitutional petition filed by M/s Paradis Pipe Industries & Engineering Worlds, M/s Umer Steel, M/s AKK Enterprises SMC-PVT Ltd seeking release order for imported Cold Rolled Steel Sheets on Coils.

On 14 March 2022, during the hearing, Adeel Awan Advocate appeared before the court and argued that petitioner is on urgent basis, therefore, court may grant his urgent application.

After the hearing, court granted urgent application and issued notices to the customs officials and DAG.

During the hearing, counsel for the petitioners’ states that petitioners are importers and traders of above-mentioned goods and during the course of business, have imported the same and filed goods declaration according to law.

He added that however, petitioners are seriously aggrieved and prejudiced by the imposition of extra duty imposed by the customs officials without any justification and lawful authority, when petitioners approached customs officials to release the same on provisional release, they denied to accept petitioners’ request.

Citing Secretary Ministry of Finance, Chief Collector of Customs Appraisement South, Collector of Customs Port Muhammad Bin Qasim and others as respondents, petitioners pleaded the court to declare that act of the respondents is illegal, no legal effect, arbitrary and unlawful.

Counsel for the petitioners, further pleaded the court to direct them to release petitioners’ imported goods immediately according to law and may restrain customs officials from taking any adverse action against the petitioners till final judgement in this petition.
