M/s Zee Impex moves SHC against detention of consignment due to valuation dispute

KARACHI: M/s Zee Impex has approached the Sindh High Court (SHC) against detention of Malamine Faced Laminated Chipboard Panels (MFC Board) iron/ steel accessories imported from China due to valuation dispute.

On 23 November 2019, counsel for the petitioner filed a petition and argued that in the normal course of business,  the petitioner has booked the cargo which in consisting of Malamine Faced Laminated Chipboard Panels of HS Code 4410.1100, value $18676.28 and iron/ steel accessories of HS Code 8302,4200, 730/kgs US$474.50 with M/s Yekalon Industry Inc, China.

He further submits that on arrival, petitioner filed goods declarations, however, the assessment group-III has not accepted the examination report and re-examined the containers and changed the description as kitchen cabinets is CKD condition and enhanced the value from $18,676.28 to $2170.041.00.He argued that after such illegal exercise due to the reasons best known to the respondents the delivery was detained.

Citing chairman FBR, Collector of Customs Appraisement Port Qasim, Deputy Collector of Customs Assessment Group-III as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and direct them to release his consignment immediately and restrain them from taking any coercive action against the petitioner till final order in this petition.
