Mis-declaration: Customs court seeks progress report against M/s Amir & Co and others

KARACHI: The Customs Court directed Investigation officer of Collectorate of Customs Port Muhammad Bin Qasim Karachi to submit progress report against owner/ partners of M/s Amir & Co and others, who were nominated in a case for mis-declaration and concealment of actual description, specifications and constituent material to deceive application of correct assessable value.

On 26 January 2021, investigation officer informed that on actionable information, customs goods declaration was selected of above-mentioned importer through system from examination and on examination, the declare description and part number were verified and spark plugs for four wheelers and motorcycle were assessed on available valuation ruling which was meant for non-iridium carbon tips spark plugs.

Investigation officer further submitted that during the investigation, it was established that the above-mentioned importer with active connivance of his clearing agent has mis-declared the description by not declaring the correct information regarding constituent material of spark plugs tip aiming to defraud the national exchequer of its legitimate revenue to the tune of Rs44, 435, 621 willfully and with malafide intention on account of customs duty and other taxes.

According to the prosecution, case was registered against the above-mentioned for violation of under section 32 (1) & (2), 32A, 79, 192 & 209 of the customs act, 1969, read with sections 3. Of the sales tax act, 1990 and section 148(I) of the income tax ordinance, 2001 punishable under clauses 14, 14A 45 & 86 of section 156 (I) of the customs act, 1969 and allied laws.
