M/s A.S Trading Corp moves SHC against enhancement of black paper valuation

KARACHI: The Sindh High Court (SHC) issued notices to the Customs department and deputy attorney general on a constitutional petition filed by M/s A.S Trading Corporation against enhancement of valuation of black paper under Valuation Ruling No 1047/2017.

During the hearing, a two-member bench, headed by Justice Aqeel Ahmed Abbasi, also directed them to make sure filing their comments on next date of hearing.

On November 17, 2018, during the hearing, counsel for the petitioner argued that petitioner is seriously aggrieved and highly prejudiced by the actions of the respondents, whereby the Collector of Appraisement East is assessing the imported consignment of the black paper, duty and taxes on the basis on VR No 1047/2017, issued by the Director of Customs Valuation working under DG Directorate General of Customs Valuation, despite the fact that the impugned valuation ruling is not sustainable the eyes of the law and has accordingly been challenged by the petitioner under section 25D of the act.

Citing Chairman Federal Board of Revenue, Chief Collector of Customs South, Collector of Customs Appraisement East and other as respondents, importer pleaded the court to declare that the impugned circular dated 22/11/17 is unlawful, confiscatory, arbitrary.

Importer also pleaded the court to restrain them from taking any coercive action against importer till final order in this petition.
