M/s Essa Steel moves SHC for allowing amendments in shipping documents

KARACHI: M/s Essa Steel Private Limited has filed a constitutional petition before the Sindh High Court (SHC) seeking direction for allowing amendments in shipping documents from another importer to the petitioner.

On September 21, 2019, counsel for the petitioner argued that during the course of its business the respondent M/s Roya Steel imported cold rolled/ re-painted steel sheets secondary quality from M/s Gemcor International Inc, iron & steel products from M/s Gemcor International Inc, iron & steel products from M/s Teanoisd S.R.L and the same was shipped in favour of the said importer made a total of 5 such imports.

He submits that the consignments arrived on various dates, however, the said importer was unable to make/ clear the payments due and as a result, the various shippers approached the petitioner and asked the petitioner to purchase the same, as a result petitioner made the payment and shippers and the shipping line all wrote to the customs authorities to have the goods changed in the name of petitioner.

He argued that petitioner being aggrieved and dissatisfied by the illegalities of the respondents with respect to the refusal to allow amendments in shipping documents.

Citing secretary finance, chairman FBR, Chief Collector of Customs Appraisement Port Muhammad Bin Qasim and others as respondents, petitioner pleaded the court to declare the actions of the respondents as mala-fide, illegal and unlawful, arbitrary and without any jurisdiction.

He also pleaded the court to direct them to immediately allow the amendments sought and direct them to immediately release the goods of the petitioner and restrain them from taking any coercive action against the petitioner till final order in this petition.
