M/s Imperial Metal Industries moves SHC for restoration of sales tax registration

KARACHI: The Sindh High Court (SHC) has issued notices to the Tax Department and deputy attorney general on a constitutional petition filed by M/s Imperial Metal Industries seeking restoration of its sales tax registration blocked by customs authorities.

During the hearing of the petition, a two-member bench, headed by Justice Aqeel Ahmed Abbasi, directed them to file their respective para wise comments on the next date of hearing. The court then adjourned the hearing for April 7, 2017.

Earlier, counsel for the petitioner stated that petitioner is services providers and paying all liabilities regularly. However, the officials of the tax authorities blocked its sales tax registration without passing any order or issuing a show cause notice.

Citing Chairman Federal Board of Revenue (FBR), commissioner Inland Revenue Regional Tax Office-II as respondents petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary, it also pleaded the court may set aside impugned notification and restore its sales tax registration immediately.
