SHC restrains tax authorities from recovering disputed amount from M/s Shangrila Limited

KARACHI: The Sindh High Court (SHC) has restrained the tax authorities from recovering Rs 27,122,880 from M/s Shangrila (Private) Limited.

The court ordered this on a constitutional petition filed by the petitioner, challenging an impugned demand notice issued by deputy commissioner Inland Revenue Enforcement and Collection Unit Zone-IV Large Taxpayers Unit.

A two-member bench also directed the tax authorities and deputy attorney general to file their para wise comments on the next date of hearing.

During the hearing, counsel for the petitioner, informed the court that the petitioner is engaged in the business of manufacturing, possessing, buying, selling, packaging of various foods items and fulfills all the liabilities properly, however, above mentioned tax department issued a notice for recovery of disputed amount which is already subject matter pending before concerned appellate forum.

Citing chairman Federal Board of Revenue, Secretary Ministry of Law, Commissioner Inland Revenue, Zone-V, Large Taxpayers Unit-I and Deputy Commissioner Inland Revenue Enforcement & Collection Unit Zone-IV Large Taxpayers Unit as respondents, counsel pleaded the court may restrain them from taking any coercive action.
