KARACHI: The Sindh High Court (SHC) issued notices to the customs department and deputy attorney general on a petition filed by M/s Stamco Steel Corporation Private Limited against deciding the dispute relating to prime quality or secondary quality of imported steel coils by the petitioner.
While the hearing of petition, a two-member bench, headed by Justice Aqeel Ahmed Abbasi also passed interim order and restrained the customs officials from taking any adverse action against the petitioner till next date of hearing.
On October 2, 2018, Haider Waheed Advocate, counsel for the petitioner, stated that petitioner imported a consignment of prime quality galvalume steel coils from China and filed Goods Declaration (GD) according with law and petitioner also furnished Mill Text Certificate, Packing Certificate, etc.
However, in view of clause-III of the public notice, an additional condition has been imposed, according to which, the consignments comprising of assorted coils where variation in weight (owning to length width or thickness) is more than 20% of the consignment in terms of number of coils.
He further explained that (this means 80% of the consignment shall have uniform weight in terms of number of coils) which condition, cannot be met, as admittedly, such coils are of different size, weight and thickness, he submitted that there are other methods available which includes the lab test as well, therefore, the size of coils cannot be made basis for the purposes of verification of the quality.
