M/s Tahir Steel Impex challenges VR 1213/2017 in SHC

KARACHI: The Sindh High Court (SHC) has issued notices to the customs authorities and deputy attorney on a constitutional petition filed by M/s Tahir Steel Impex against Valuation Ruling 1213/2017 dated 27/09/2017 enhancing the valuation without considering the point of view and suggestions of the stakeholders.

While the hearing of petition, a two-member bench, comprising Justice Munib Akhtar and Justice Omer Sial, also directed them to file their respective para wise comments on the next date of hearing.

Earlier, counsel for the petitioner stated that it is engaged in the lawful business of import and export and fulfills all the legal requirement according with law, however, director of customs valuation issued above mentioned valuation ruling without due consideration of the merits, DATA and documents furnished by importers, further the customs authorities ignored the tangible mechanism as confined in the meeting for determination of value of secondary quality of goods duly signed by the stake holders.

He submitted that enhance above noted Valuation Ruling 1213/2017 issued is unfair and without consideration of stake holders view point and suggestions.

Citing Secretary Revenue Division, Collector of Customs Appraisement West, Director General Valuation, Customs House Karachi and Director Customs Valuation as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.

He also pleaded the court may restrain them from taking any coercive action against the petitioner and release the consignments imported by the petitioner subject to the deposit of pay order/ bank guarantee of differential amount.
