M/s Zaniq Green moves SHC against seizure of used cut tyres

KARACHI: The Sindh High Court (SHC) issued notices to customs department and deputy attorney general on a constitutional petition filed by M/s Zaniq Green Private Limited seeking release of its consignment of cut tyres.

A two-member bench headed by Justice Aqeel Ahmed Abbasi heard the matter on October 5, 2018.

During the hearing, counsel for the petitioner stated that petitioner is engaged in the lawful business of scrap metals, scrap tyres, dry fuel, smelter, spinners and other related goods and always fulfills all the legal formalities.

He submitted that petitioner imported a consignment of used cut tyres from UAE; however, despite issued NOC by environment protection agency, customs officials stopped its consignment without showing any reason.

Citing Chairman Federal Board of Revenue, DG Pakistan Environmental Protection Agency and collectorate of customs Port Muhammad Bin Qasim as respondents, importer pleaded the court to declare that act of the respondent as illegal, mala fide and arbitrary. He also pleaded the court to direct them to release the consignment and restrain them from taking any adverse action against the petitioner till final order in this petition.
