SHC disposes of petition filed by Topsun Chemical Enterprises

KARACHI: The Sindh High Court (SHC) on Tuesday disposed of a constitutional petition filed by M/s Topsun Chemical Enterprises, seeking restoration of its NTN blocked by the custom authorities. A two-member bench, comprising Justice Irfan Sadat Khan and Justice Muhammad Humayun Khan, heard the petition.

During the hearing, counsel for the petitioner informed the court that the purpose of filing of this petition was to unblock the NTN number and he does not want to press this petition. Therefore, the court disposed of the petition.

Earlier, counsel for the petitioner stated that petitioner is enter alia engaged in the business of import of pesticides and imported the consignment of Thiophanate Methyl WP 70% from China and filed goods declarations, however, staff of the custom department seized the same and lodged the FIR against the petitioner dated 17/04/2016 and blocked the NTN of the Petitioner.

According to the petitioner, respondents alleged that petitioner is involved in tax evasion which is baseless and mala fide act of the respondents, due to blocking of the NTN , petitioner is seriously surfing and huge loss.

Citing the Chairman Federal Board of Revenue (FBR), Collector of Customs Model Custom Collectorate East, Collector of Cusotms Model Custom Collectorate West as respondents, petitioner pleaded the court may declare that act of the respondents in illegal, mala fide and of no legal effect and set aside the FIR which was lodged against the petitioner. Petitioner also pleaded that court direct the respondents to de-block the NTN of the petitioner.
