Customs Valuation issues Order-in-Revision No 68 against addendum VR No 538

KARACHI: The Directorate General of Customs Valuation has issued Order-in-Revision No 68/2014 against the addendum Valuation Ruling No 538/2013.

According to details, the petitioner M/s RAK Trading Limited-Lahore submitted a petition before the then Director General of Customs Valuation Robina Ather against the addendum VR No 68/2014 in which the importer adopted the view point that the authorities concerned of Customs Valuation Department were not taking them into confidence while determining the Customs values of the Porcelain/Ceramic Tiles imported from United Arab Emirates (UAE) Origin.

In the petition, the importer was of the view that the department has revised China origin tiles valuation two times on lower side, but adversely department has increased UAE Origin valuation without hearing the version along with the factual grounds, and due to this the importers of porcelain/ceramic tiles from UAE Origin are facing too much heavy losses.

The importer further added that in the light of the above mention fact we are filling review petition Under Section 25-D of the Customs Act, 1969 against the addendum Valuation Ruling No 538/2013 with the hope that the department shall thoroughly study and analyze the review petition as compare to China Tiles value.

The then Director General of Customs Valuation Robina Ather in the order stated, “I have heard the arguments of the petitioner and the department representatives and it seems that due consideration has not been given to the market price while revising applicable values in impugned VR No 538/2013”.

In the Order-in Revision, Robina Ather further stated, “I am convinced that values for middle east origin tiles (all categories) fixed in the impugned ruling are on higher side. It is therefore, ordered that value of Middle East Origin Ceramic, Porcelain (polished) and Porcelain Matt/Glazed as in Table-E, F and G of addendum are reduced by 20per cent.
