Owner moves SHC seeking release of vehicle involved in smuggling

KARACHI: Real owner of Nissan truck trailer namely Tariq Mahmood son of Muhammad Hayyat has filed a writ petition before the Sindh High Court (SHC) seeking its vehicle which was allegedly involved in smuggling of foreign origin betel nuts.

On 22 July 2020, counsel for the petitioner stated that Pakistan Coast Guards raided and said vehicle was found without any driver at the time of seizing due to alleged level of smuggling of betel nuts against said vehicle and such case registered by PCG and decided by the Collectorate of Customs Adjudication-1 at Customs House Karachi in favor of driver Abdul Razzaq against 20 percent fine.

He said that when it came to know about his vehicle in case of smuggling, he approached to officials authority and produced all original documentary evidence which is clearly showing that just petitioner is real owner of said vehicle and there is no other person except him but the official authority of Pakistan Coast Guards raised objection first get an order or direction from the SHC.

He submitted that there is no remedy available except this petition, the petitioner is legal law full owner of above said vehicle and respondents may release at earliest said vehicle to just original and real owner.

Citing Director General of Pakistan Coast Guards, Collectorate off Customs Adjudication-1 and others as respondents, petitioner pleaded the court may be pleased pass the direction to respondent that such vehicle handed over to lawful and original owner and further prayed the respondent driver kindly be directed to restrained from getting of said vehicle, any other relief, prayer is made in the interest of the justice.
