PCA files another FIR against H. Ali Construction Co on charges of tax evasion, mis-declaration

ISLAMABAD: Directorate General Post Clearance Audit (PCA) Headquarter has lodged a 2nd FIR No. 04/2017 against M/s H. Ali Construction Company Mughalpura, Lahore on the charges of tax evasion and mis-declaration under section 2 (s), 16, 32 and 79 of the Customs Act, 1969 and seized two more imported used prime movers worth Rs 5.43 million.

According to details, Directorate General of PCA had seized the used prime movers of H.Ali Company under 168 of the Customs Act 1969, at Container Freight Station, Lahore and released under GD 9329. Clearance of six used prime movers was sought by the importer under the above said GD. The goods had been cleared and released by the customs and were seized while awaiting permission from M/s NLC.

It is necessary to mention here that M/s H. Ali Construction Company is already facing the same charges in FIR No. 02/2017 which was registered on 16th February 2017 and now on the same charges 2nd FIR has been lodged against the partners of M/s H. Ali namely Zulfiqar (CNIC 81302-3277478-1), Ch Asad Ali (CNIC 81302-1289803-3) and two others.

It is revealed that the importer found involved in mis-declaration and fraud and was able to get release of these vehicles from Customs in breach of prohibition and restriction which was in force (the restriction being that used prime movers of only 380 HP or above engine capacity were allowed import, whereas these prime movers were less than 380 HP engine capacity (model P11c).

Also the importer knowingly and fraudulently got released these used prime movers released from Customs without establishing his bonafide being a genuine construction company and without verified construction projects, without establishing his eligibility and entitlement to import these used prime movers.
