PCA unearths Rs13.75m evasion of duties & taxes by M/s Zohaib Enterprises

KARACHI: The Directorate of Customs Post Clearance Audit has detected an evasion of duties and taxes of Rs 13.75 million by M/s Zohaib Enterprises Karachi, it is learnt.

The official sources told that M/s Zohaib Enterprises Karachi imported a consignment of printing machine rulers, printing sheets and other parts from Germany under the PCT Heading 4509.3488 and got it cleared from the PICT Karachi vide GDs on April 22, 2017 by paying customs duty at eight percent after claiming the benefit of the SRO 728/2007.

However, the subject items are correctly classifiable under the PCT 5606.4578 attracting customs duty at 10 percent and income tax at 14 percent thus, but through mis-declaration of classification, M/s Zohaib Enterprises Karachi evaded/short-paid Rs 13.75 million with support of Examiner Qayyum Shah on PICT and Appraiser Toufeeq Ali.

Sources told reporter that the importer has violated the provisions of Section 56 (8) & (6A) of the Customs Act-1969, Section 15, 16 read with Section 88 of the Sales Tax Act-1990 and Section 186 of Income Tax Ordinance 2001 punishable under clauses (156) and 125 of Section 768(9) of the Customs Act-1969, Section 72 of the Sales Tax Act-1990 and Section 80 & 124 of Income Tax Ordinance 2001 and Section 9-A of the Sales Tax Act-1990 read with Chapter X of the Sales Tax Special Procedure Rules 2007 (Special procedures for payment of sales tax by the importers) and under relevant provisions of Income Tax Ordinance 2001.

Earlier, the Directorate of Customs Post Clearance Audit (PCA) has unearthed evasion of duties and taxes of Rs 14.67 million by M/s Alam Alam & Sons Karachi.
