MULTAN: Customs Adjudication has issued the Order in Original against the seized 392,000 litres smuggled high speed diesel of Byco Petroleum Company Limited after the completion of proceeding.
According to details, Additional Collector Adjudication Amjadur Rehman conducted the proceeding of seized High Speed Diesel of Byco Petroleum Limited Company. At least nine oil tankers full of high speed diesel were seized by the Customs Intelligence and Investigation Multan during an operation. The Customs authorities gave the company time to submit legal documents.
During the preceding of the case, the Customs authorities alleged that the seized HSD was smuggled, but the Byco Petroleum argued that the refined HSD was being transported from their oil refinery. However, the company failed to submit any legal evidence to prove its claim.
The Customs Intelligence and Investigation Multan Range have also presented the report after examining the Byco Petroleum Company Limited for the last six months in respect of all depots, number of oil tankers shipped along with quantity sold, sale tax invoice, names and address of the buyer just to verify the crude oil during detention.
The Customs Intelligence and Investigation Multan revealed through chemical examination that the seized High Speed Diesel oil nature was change in colour and gravity obtained from the samples of seized High Speed Diesel oil. While the Byco Petroleum Company was claiming that the HSD oil was refined from the locally manufactured crude oil but due to contradiction in their chemical examination.
Additional Director Customs Intelligence and Investigation Multan Office Nisar Ahmad have submitted the comments in the Customs Adjudication during preceding against the Byco Petroleum Company oil tankers after comprehensive analysis in the case. Customs intelligence has pointed out that the issue that seized HSD oil was observed and confirms thorugh laboratory examination and specifications of seized HSD examined were observed thoroughly .The reports of the laboratory proved that the seized HSD oil were not Pakistani origin in the examination as approved by the D.G oil ,Ministry of Petroleum and Natural Resources .
Customs Adjudication has accepted the view point of Customs Intelligence and Investigation Multan Range after their sufficient evidences of smuggling @lkcharges against the seized HSD of Byco Petroleum Company Limited during proceeding.
In the light of presented facts from both sides in Customs Adjudication, Additional Collector Amajd ur Rehman have issued the order in Original no. 703 in the seized case no. 149 of High Speed Diesel along with vehicle. Additional Collector has issued order for the confiscation of High Speed Deisel oil out rightly under clause 89(1) of section 157 (1) of the customs act 1969 alongwith clause (a) of preamble of SRO 499 (1).
The vehicles were also confiscated out rightly after the hearing of smuggled seized HSD oil under section 157(2) of the Customs act 1969.
The same order will dispose in all the nine seizure cases of the Byco Petroleum company limited seized High Speed Diesel Oil and oil tankers become almost Rs.70 million from Byco Petroleum Company Limited including the worth of Rs. 28 million of HSD and Rs.44 million of Vehicles involved in the transportation.
