SHC adjourns hearing of petition filed by M/s Abdul Razzak

KARACHI: The Sindh High Court (SHC) has adjourned the hearing of a constitutional petition filed by Abdul Razzak, seeking release of 78,000 liters high speed diesel which was seized by the officials of Anti-Smuggling Organization, Larkana.

A two-member bench, comprising Justice Munib Akhtar and Justice Anwar Hussain heard the petition. During the hearing, no one was present from the petitioner side, therefore, the court adjourned the hearing for the date which would be announced according to the roaster.

Earlier, petitioner’s counsel stated that on April 16, 2015 when a quantity of about 78,000 liters HSD was in its way to different sites in 6 oil tankers, at Byco Petrol Pump bypass road, Jacobabab, all of sudden, all the oil tankers of the petitioner were stopped by Pakistan Rangers and handed over to the respondents’ officials, one driver, cleaner and two employees of the Byco Petrol Pump were arrested. All the HSD along with oil tankers were seized and despite showing all the documents of the HSD by the drivers. Petitioner stated that these 4 persons were booked under FIR no 04/2015 and they are still under confinement at Central Jail Karachi.

Citing secretary Revenue Division, collector Model Customs Collectorate, Hyderabad, additional collector Customs Collectorate, Hyderabad, assistant collector Customs Collectorate, Hyderabad, Superintendent Customs Anti-Smuggling Organization, Larkana and M/s Askari Oil Services Pvt as respondents, Petitioner pleaded the SHC may declare that the HSD belonging to the petitioner has unlawfully been confiscated by the officials of the customs authorities without process of law.

Petitioner also pleaded that SHC may direct the respondents to release the same HSD Oil and restrain them from taking any coercive action against the petitioner.
