SHC allows petition filed by M/s JW SEZ seeking release of imported consignment

KARACHI: A two-member of the Sindh High Court (SHC), headed by Justice Shafi Muhammad Siddiqui allowed a constitutional petition filed by M/s JW SEZ Private Limited seeking release order of imported consignment of 2080 CBU units of MG HS SUV.

On 22 December 2021, during the hearing, Kashif Nazir along with Gulam Shaikh advocates for petitioner, Kafeel Ahmed Abbasi deputy attorney general, Hussain Bohra assistant attorney general of Pakistan appeared before the court.

Petitioner filed an urgent application which was granted by court, however, Rana Sakhawat Ali Advocate holding brief on behalf of Shahab Imam advocate who is representing the respondent Customs Appraisement & Facilitation West. He has submitted instructions from Shahab Imam to call no objection to his application for the return of security, with the consent of the respondents’ counsel, the application is allowed, let the treatment be given as far as return of security is concerned.

Earlier, counsel for the petitioner argued that his client is doing lawful business of imports and during the course of business, imported 2080 CBU units of MG HS SUV and filed goods declaration according to law, however, customs officials assessed higher valuation instead of declaring and due to which consignment was seized.

citing Chairman Federal Board of Revenue, Collector of Customs Appraisement West, Deputy Collector of Customs Appraisement West, Deputy Collector of Customs Port Muhammad Bin Qasim and others as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

He also pleaded the court may direct them to release petitioner’s imported consignment and restrain them from taking any adverse action against the petitioner till final order in this constitutional petition.
