SHC appoints Dr Shahab Imam advocate as amicus curia

KARACHI: A two-member bench of the Sindh High Court (SHC) has appointed Dr Shahab Imam Advocate High Court as Amicus Curia ( friend of the court ) so as to assist in the matter of valuation of Iron goods booked under Letter of credit on a constitutional petition No 7101 of 2021.

On 24 February 2022, during the hearing, Muhammad Adeel Awan Advocate for the petitioner, Afsheen Aman Advocate for customs officials, Mirza Nadeem Advocate for customs department, Kafeel Ahmed Abbasi Deputy Attorney General of Pakistan and Dr Shahab Imam, Amicus Curiae appeared before the court.

During the hearing, counsel for the both sides argued and after their arguments, court passed an order and observed that “learned counsel are advancing their arguments where Mr Shahab Imam, Advocate has been appointed as amicus curiae.

Mr Shahab Imam advocate has informed the court that the assertion of the learned counsel for the petitioner to the extend that in the case of LCs duties are assessed from the date of the LC rather than date of Bill of lading are not well founded, where in fact in case of LCs also, good are assessed from the date of fling of Bill of lading: which assertion, however, is refuted by learned counsel for the petitioner.

Both sides are directed to substantiate their assertions from examples filed through statement”.
