SHC calls comments from customs on petition filed by M/s Khan Trading

KARACHI: The Sindh High Court (SHC) has directed the customs department to file their respective para wise comments on a constitutional petition filed by M/s Khan Trading Company (Private) Limited, challenging Valuation Ruling number: 1145/2017 dated 2/5/2017. A two-member bench, comprising Justice Munib Akhtar and Justice Omer Sial, was hearing the petition.

Earlier, counsel for the petitioner stated that he is importer of door locks, door sliders and hinges made of iron steel and always fulfills legal requirements. He submitted that it imported a consignment of door locks, door sliders and hinges made of iron steel from China and filed goods declaration (GDs). However, the petitioner is seriously aggrieved by order of the respondents who issued valuation ruling no 1145/2017 dated 02/05/2017 for enhancement of valuation, customs duty and taxes.

Citing Secretary Revenue Division, Chairman Federal Board of Revenue, Chief Collector of Customs, Collector of Customs Model Customs Collectorate Appraisement South, Collector of Customs Model Customs Collectorate Appraisement West, Director Directorate General of Customs Valuations as respondents, the petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary.

He also pleaded the court to declare the said valuation ruling as illegal and has no legal effect, counsel pleaded the court to restrain them from taking any coercive action against the petitioner till final judgment of this petition.
