SHC calls comments from tax dept on petition filed by M/s Ashraf Traders

KARACHI: The Sindh High Court (SHC) has issued notices to the tax department and deputy attorney general on a constitutional petition filed by M/s Ashraf Traders, challenging impugned valuation ruling no 863/ 2016, enhancing values of toilet soap.

While the hearing of the petition, a two-member bench, headed by Justice Munib Akhtar also directed them to file their respective para wise comments on the next date of hearing.

Earlier, counsel for the petitioner stated that petitioner is engaged in the business of toilet soap and for this purposed imports toilet soap from various countries of the world.

According to the petitioner, however, petitioner is seriously aggrieved and prejudiced by the illegal and mala fide action of the Director of Valuation and Directorate General of Valuation Department who enhanced the valuing on toilet soap in respect of impugned valuation ruling no: 863/ 2016 dated 02/06/2016 which is complete ignorance of the factual and legal narrations.

Citing Secretary Revenue Division, Collector of Customs Appraisement East, Collector of Customs Appraisement West, Directorate of Valuation, the Directorate General of Valuation as respondents, he pleaded the court may declare that act of the customs officials in illegal, mala fide and arbitrary. Counsel for the petitioner also pleaded the court may set aside impugned valuation ruling.
