KARACHI: The Sindh High Court (SHC) directed customs officials to file their respective para wise comments on a constitutional petition filed by M/s Usman, M/s Hero Motors Ltd, M/s Z and D Metal Corporation and others against detention of imported cold rolled steel sheets detained by customs officials due to disputed valuation.
Dated 18 March 2022, during the hearing, counsel for the petitioners’ states that petitioners are importers and traders of above-mentioned goods, during the course of business, have imported the same and filed goods declaration (GD) according to law.
He added that however, petitioners are seriously aggrieved and highly prejudiced by the imposition of extra duty imposed by the customs officials without any justification and lawful authority, when petitioners approached customs officials to release the same on provisional release, they denied to accept petitioners’ request.
Citing Secretary Ministry of Finance, Chief Collector of Customs Appraisement South, Collector of Customs Port Muhammad Bin Qasim and others as respondents, petitioners pleaded the court to declare that act of the respondents as illegal, no legal effect, arbitrary and unlawful.
Counsel for the petitioners, further pleaded the court may direct them to release petitioners’ imported goods immediately according to law and may restrain customs officials from taking any adverse action against the petitioners till final judgement in this petition.
