KARACHI: The Sindh High Court (SHC) has directed the tax department to issue delay, detention certificates to M/s Millat Trading Co, M/s Al-Ahmed Trade Center and M/s W.A International against their consignments of wire locks.
A two-member bench, comprising Justice Munib Akhtar and Justice Saeeduddin Nasir heard the case and issued directions.
During the hearing, counsel for the petitioners stated that the petitioners do not wish to proceed further with this matter as grievances have been redressed but petitioners are entitled to issuance of delay certificate and prayed accordingly; therefore, the court dismissed the petition and directed the tax authorities to issue delay, detention certificates to the petitioners.
Earlier, counsel for the petitioners stated that petitioners imported consignments of wire locks and paid the duty and taxes thereof as per assessment on declared transaction values.
According to the petitioner, the deputy commissioner of Model Customs Collectorate Appraisement-West working under the instructions and direction of the Revenue Division Secretary and collector neglected to allow release of the said consignments which are lying within port area since long time and have been incurring heavy demurrages and detention charges.
The counsel further mentioned in the petition that the petitioners had approached the respondents for release of their consignments and opted to secure the likely differential amount through bank guarantee but they refused their request.
Citing Revenue Division Sectary, Customs Appraisement-West collector and deputy collector as respondents, the petitioners pleaded the SHC may direct the respondents for release their consignments. The counsel further pleaded the court may direct the respondents to issue delay, detention certificate to the petitioners.
