SHC directs Appraisement-West to release consignments of solar fans

KARACHI: The Sindh High Court (SHC) has directed the tax authorities to release the consignment of “solar fans” on subject of payment of entire differential amount by the petitioner in the shape of pay-order.

The SHC ordered this on a constitutional petition filed by Muhammad Jamshad Butt seeking release order of his consignment.

A two-member bench, comprising Justice Munib Akhter and Justice Saeeduddin Nasir, was hearing a constitutional petition filed by Muhammad Jamshed Butt seeking release of his consignment.

Earlier, counsel for the petitioner stated in his petition that his client is a proprietor of M/s J.B. Shoes and is importer of the different miscellaneous items, adding that the petitioner imported two consignments of DC solar fans of China origin and filed goods declarations as accordance with law and declared the unit price $2.00 per unit and deposited duty and taxes in the bank.

According to the petitioner, after payments, importer had approached the respondents for release of his consignments, however, he was informed by the officials of the tax authorities that during the examination declared value of the consignments was not accepted by the respondents therefore, the consignments are not being cleared/released by the respondents.

Citing Ministry of Finance, Customs Appraisement-West collector and deputy collector as respondents, the petitioner pleaded the court may declare that act of the respondents is illegal mala fide and unlawful.

Importer also pleaded the court may direct the respondents to release the consignments of the petitioner and restrain the respondents from taking any coercive action against the petitioner.
