SHC directs customs officials to restore ID password of M/s Noor Brothers International

KARACHI: A two-member bench of the Sindh High Court (SHC) has passed interim order and restored ID password of the petitioner till next date of hearing on a constitutional petition filed by M/s Noor Brothers International seeking restoration of its ID Password blocked by customs officials.

On 4 March 2022, a two-member bench, headed by Justice Irfan Sadat khan heard the matter.

During the hearing, Sardar M Ishaq advocate for petitioner appeared before the bench and moved urgent application, he states that matter is urgent basis, therefore, court may grant urgency.

After the hearing, court passed order that “urgency granted, learned counsel for the petitioner states that their ID and Password has been illegally blocked by the respondents without any legal jurisdiction, let notices to be issued to respondents as well as deputy attorney general of Pakistan and till next date of hearing, the blocking of ID Password and NTN is suspended”.

Earlier, counsel agued in his constitutional that importers imported consignment of DC Solar agricultural submersible pump with solar pump controller and all standard accessories from China and filed goods declaration according to law.

He further argued that despite, all legal formalities, customs officials issued show cause notice and allegation was fixed for mis-declaration and after that petitioner’s ID, Password and NTN have been blocked without any justification.

Citing Chairman Federal Board of Revenue, Collector of Customs Port Muhammad Bin Qasim and others, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

He also pleaded the court to direct them to restore petitioner’s ID, Password and NTN and restrain them from taking any adverse action against the petitioner till final order in this petition.
