SHC directs customs to release consignment of prime quality steel sheets

KARACHI: The Sindh High Court directed Customs authorities to release consignment (prime quality steel sheets) of M/S Umer and Company upon payment of duties and taxes as well as penalty thorough Nazir of the court or bank guarantee.

The SHC division bench headed by Chief Justice Sajjad Ali Shah passed these directions while hearing the petition filed by M/S Umer and Co.

Earlier, the counsel of the petitioner stated that the company had placed an order for purchased of ” prime quality” steel sheets. The supplier supplied the goods stuffed into 33 containers and issued shipping documents against the same goods such as commercial invoice.

The petitioner stated that on the basis of shipping documents, the prepared the goods declaration for into-bond as on 27/10/2015. The goods under in-bond GD was liable to be shifted from port area to the bonded warehouse under delay which the respondents have been neglecting and delaying under apparent non-bonafides.

The petitioner stated that it has incurred extra penalty of Rs 4,000,000 till the date of filling of captioned case, which has been rising higher due to each day of delay. According to the petitioner, it has made various requests for shifting of consignment from port to bond, but all in vain.

The court was requested to allow in-bonding of the consignment and immediately shifting of the consignment from port to bonded warehouse and refer the matter to the steel committee to resolve the dispute of quality of goods through an independent and impartial forum.
