KARACHI: The Sindh High Court (SHC) directed customs officials to conduct action strictly in accordance with law and not take any coercive action against the petitioner on a petition filed by M/s Royal Impex Private Limited against holding consignment of iron and steel sheet in coils and bundles.
On Jan 30, 2019, counsel for the petitioner stated in his constitutional petition that petitioner imported above-mentioned goods accordance with law and filed goods declaration as per law, however, customs officials exercised powers conferred by export processing zone (EPZ) and held the consignment illegally, unlawfully and without jurisdiction.
He further argued that action of the said respondents is in violation of the fundamental rights of the petitioner guaranteed under article 4, 18 and 23 of the constitutional of Islamic Republic of Pakistan 1973.
Citing chairman Federal Board of Revenue, DG I&I-FBR, Director I&I-FBR, Collector Appraisement Port Muhammad Bin Qasim and others as respondents, petitioner pleaded the court to declare that respondents has been illegally, unlawfully and without jurisdiction withheld the consignments in transit to EPZ and direct the said respondents to release the same forthwith.
Importer further pleaded the court may restrain them from taking any coercive action against the petitioner till final order in this petition and grant any other relief deemed fit in the circumstance of the case and grant order as to costs.
