SHC directs tax authorities to issue delay detention certificate to M/s Sun Steel Industries

KARACHI: The Sindh High Court (SHC) has directed the tax authorities to issue delay detention certificate in accordance with the law to the petitioner within two weeks.

The court ordered this on a constitutional petition filed by M/s Sun Steel Industries, seeking release orders of the transshipment of the imported raw material of the petitioner to Sambrial EPZ under section 226 of the Customs Act 2001. A two-member bench, comprising Justice Munib Akhter and Justice Anwar Hussain, was hearing the petition.

During the hearing, counsel for the department filed a reply. However, the counsel for the petitioner submitted that he has no objection and he only wants delay detention certificate, therefore, the court directed the respondents to issue a delay detention certificate to the petitioner and disposed of the petition.

Earlier petitioner’s counsel stated that petitioner is manufacturing concern and having its manufacturing activity in export zone . Petitioner imported raw material which has been lying within port area and custody of the Collector of Customs Appraisement East since November 12,2015.

According to the petitioner, it filed the trans-shipment goods declaration and approached the respondents for allowing trans-shipment of the said goods for Sambrial export processing zone, because the respondents blocked the filing and processing of such goods declaration for trans-shipment in their computer system with mala-fide intents and for the purpose of under-enrichment unlawfully.

Citing chairman Federal Board of Revenue (FBR), Chief Collector of Customs Appraisement South, Collector of Customs Appraisement East as respondents, petitioner pleaded the SHC may direct the respondents to allow trans-shipment of the imported raw material of the petitioner to Sambrial EPZ under 226 of Customs Act 2001.
