SHC directs to release consignment imported by Al Hamd Corporation Private Limited on bank guarantee

KARACHI: The Sindh High Court (SHC) directed customs officials to release imported consignment of fresh ginger garlic on provisional release after securing a differential amount in the shape of bank guarantee or pay order on a constitutional petition filed by M/s Al Hamd Corporation Private Ltd.

On 10 December 2021, a two-member bench, headed by Justice Shafi Muhammad Siddiqui heard the matter.

During the hearing, Imran Iqbal Khan advocate for petitioner, Kafeel Ahmed Abbasi Deputy Attorney General, Hussain Bohra Assistant Attorney General for Pakistan and Muhammad Rashid Arif advocate appeared before the court.

Irfan Mir Halepota advocate filed vakalatnama for customs officials which was taken on record.

After the hearing, the court observed in its order that “subject matter of this petition is a challenge that involves a valuation ruling which is beyond the statutory of 90 days, petitioner intends to secure the differential amount between the applied valuation ruling and the goods declaration.

Let goods be released on securing the differential amount with the concerned collectorate, petition stands disposed of along with listed application”.

Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector of Customs as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary and restrained them from taking any adverse action against the petitioner till final judgment in this case.
